Terms of Service

Cre8 ("the Application") is a photo editing and design application for Apple mobile devices, licensed to you by Makesour Ltd, located at 86-90 Paul Street, London, EC2A 4NE, United Kingdom ("Licensor"). By downloading the Application from the Apple App Store and using it, you agree to be bound by these Terms.
1. The Application
Cre8 is photo editing and design software for Apple mobile devices. The Application is not tailored to comply with industry-specific regulations (such as HIPAA, FISMA, GLBA, or similar). If your interactions are subject to such laws, you may not use the Application in a way that would cause a violation of them.
2. Scope of License
You are granted a non-transferable, non-exclusive, non-sublicensable license to install and use the Application on Apple-branded devices that you own or control, in accordance with the App Store Terms of Service. You may not:
- Share or make the Application available to third parties without the Licensor's consent.
- Reverse engineer, decompile, disassemble, translate, or attempt to derive the source code of the Application.
- Copy (except as expressly permitted), modify, or create derivative works of the Application or any part of it.
3. Technical Requirements
The Licensor endeavors to keep the Application compatible with current device firmware. However, the Licensor does not guarantee compatibility with every device or firmware version. You are responsible for confirming that your device meets the Application's technical requirements.
4. Maintenance and Support
The Licensor is not obligated, expressly or implicitly, to provide any maintenance or technical support beyond what is required by applicable law. Apple has no obligation to furnish any maintenance or support services with respect to the Application.
5. User-Generated Content
You are solely responsible for the photos, images, text, and other content you create, import, or edit using the Application. You represent and warrant that your content does not infringe any third party's intellectual property or privacy rights, is not unlawful, obscene, harassing, or otherwise objectionable, and complies with all applicable laws.
6. Feedback
If you provide the Licensor with feedback or suggestions regarding the Application, the Licensor may use that feedback without restriction and without any obligation to compensate you. You retain ownership of the content you create with the Application.
7. Liability
To the extent permitted by applicable law, the Licensor's liability is limited to cases of intent and gross negligence, except in cases of breach of essential contractual obligations or injury to life, body, or health.
8. Warranty
The Licensor warrants that the Application is free of malware at the time of your download and that it functions substantially as described. Any defect must be reported within a reasonable period after discovery. If the Application is found to be defective, your remedy may be a refund through the App Store in accordance with Apple's policies.
9. Product Claims
The Licensor, not Apple, is responsible for addressing any claims relating to the Application, including product liability claims, claims that the Application fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
10. Legal Compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Termination
This license is effective until terminated by you or the Licensor. Your rights under this license terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and destroy all copies in your possession.
12. Third-Party Beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you as a third-party beneficiary.
13. Intellectual Property
In the event of any third-party claim that the Application or your use of it infringes that party's intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
14. Governing Law
These Terms are governed by the laws of the United Kingdom, excluding its conflict of law rules.
15. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, it will be replaced by a valid provision that most closely matches the intent of the original, and the remaining provisions will remain in full force. Amendments to these Terms must be made in writing.
